Terms of Service

Effective and last updated: November 3, 2026

These Terms of Service (the "Terms") are an agreement between you and GAMEBORN Inc ("GAMEBORN," "we," "us," or "our"), 7755 Center Ave, Huntington Beach, CA 92647, United States. They cover our games, including Tora Mahjong (also listed as Mahjong Solitaire) on Google Play, together with their online features, our website gameborn.games, and any related services (together, the "Services").

Please read Section 19 carefully. If you live in the United States, it requires that most disputes between you and us be resolved by binding individual arbitration instead of in court, and you give up the right to a jury trial and to take part in a class action. You can opt out of arbitration within 30 days, as explained in Section 19.8.

1. Accepting these Terms

By installing, opening or playing any of our games, you agree to these Terms and to our Privacy Policy, which explains how we handle your information. If you do not agree, please do not use the Services and uninstall the game.

2. Who may play

You must be at least 13 years old to use the Services. Our games are not directed to children under 13.

If you are 13 or older but have not reached the age of majority where you live, you may use the Services only with the permission of a parent or legal guardian, who must read and accept these Terms for you. Parents and guardians are responsible for the use of the Services by their children, including any purchases made on their devices. Google Play lets you require a password or approval for purchases; we recommend turning that on for a child's device.

3. Your license to play

Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to download, install and use our games on devices you own or control, for your own non-commercial entertainment. The games are licensed to you, not sold. All rights we do not expressly grant are reserved by us and our licensors.

4. Your game profile and Google Play Games

You do not need to create an account with us to play. When you first open the game, it creates a random player identifier on your device. Your progress is stored on your device.

If you choose to sign in with Google Play Games, the game keeps a copy of your progress in Google Play Games Saved Games, inside your own Google account, so you can continue on another device. Your Google account and Play Games profile are provided by Google under Google's own terms, and you are responsible for keeping them secure.

If you do not sign in, or if you uninstall the game or clear its data, your progress may be lost and we may not be able to restore it. We are not responsible for progress lost this way, or for anything that happens through your device or your Google account when it is used by someone else.

5. Virtual currency and items

The games include in-game currency and items such as coins, crystals, tokens, hints, shuffles, undos, chests, extra tray slots, avatar frames, name styles, tile sets, souvenirs, talismans and similar content ("Virtual Items"). You may earn them by playing or obtain them by purchase, by watching a rewarded ad, or through a promo code or gift.

6. Purchases and the VIP Pass

All purchases in our Android games are made through Google Play and are processed by Google under the Google Play Terms of Service and Google Play's payment and refund policies. We never see or store your card or payment details. Prices are shown in the game and in Google Play and may include taxes as Google determines.

7. Rewarded ads

Some games let you choose to watch a short video ad in exchange for an in-game reward. Ads are served by Google AdMob and by ad networks that take part in AdMob's mediation. Watching is always optional. A reward is given only when the ad network reports that the video was watched to the end. Ads may not always be available (for example, in some countries, without an internet connection, or when you have declined ad consent), and we do not owe a reward when no ad is shown. We are not responsible for the content of third-party ads or for products they advertise. See our Privacy Policy for how ad partners use data and how to manage your choices.

8. The League, names and conduct

The League is a weekly competition in which players are grouped with other players and see each other's player name, avatar, frame, name style and points. A weekly champion may choose one of a set of prepared lines to show to other players.

When you choose a player name, it must not:

We may, at our discretion and without notice, change or remove a name that we believe breaks these rules, reset or remove League points or results, remove a player from the League, or take other steps under Section 15. League standings depend on results the game sends to our servers. We may correct or void results that we believe were produced by cheating, bugs or tampering. Bots may fill groups so that every week has a full board.

9. Promo codes and gifts

We sometimes publish promo codes (for example, in our Facebook group) or give gifts in the game. Each code has the reward and the last day shown when it is published, can be used once per player, and has no cash value. Codes cannot be sold or traded and may not be used where prohibited by law. We may end, change or refuse a code at any time, including a code that was shared beyond its intended audience or obtained by fraud. Gifts and rewards for sharing the game are subject to the limits shown in the game.

10. Messages and suggestions

If you send us a message, idea or suggestion (for example, through "Write to the developer"), you allow us to use it freely to answer you and to improve our games, without owing you anything. Please do not include passwords, payment details or other sensitive information in messages. We may reply to you in the game.

11. Things you may not do

You agree not to:

12. Intellectual property

The games and all their content, including software, artwork, characters (such as Tora), tile designs, music, sounds, text and trademarks, are owned by GAMEBORN or its licensors and are protected by copyright, trademark and other laws. Except for the license in Section 3, nothing in these Terms gives you any rights in them. You may share screenshots and short videos of your own gameplay for non-commercial purposes, as long as you do not suggest that we endorse you.

13. Google Play and other third parties

Our Android games are distributed through Google Play and use Google services such as Google Play Billing, Google Play Games, In-App Review, In-App Updates, Firebase and AdMob. Your use of those services is also governed by Google's terms. These Terms are between you and GAMEBORN only; Google is not a party to them and is not responsible for the games or for support. We are not responsible for third-party services, websites or content linked from the games (for example, our Facebook group), which you use at your own risk.

14. Changes to the games

Games change over time. We may add, change, limit or remove features, levels, events, the League, Virtual Items or online services, and we may stop offering a game, temporarily or permanently. Online features need an internet connection and our servers, and may be unavailable at times. If we decide to stop running a game's online features entirely, we will try to give reasonable notice in the game or on this website.

15. Suspension and termination

You may stop using the Services at any time by uninstalling the game. We may suspend or end your access to the Services or any part of them (for example, the League) if we reasonably believe you have broken these Terms, if we are required to by law, or to protect players or the Services. If your access ends, your license and any Virtual Items end too, and, except where required by law, no refund is due. Sections 5, 10, 12 and 16 to 24 continue to apply after termination.

16. Disclaimer of warranties

The Services are provided "as is" and "as available." To the fullest extent permitted by law, GAMEBORN disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that progress, Virtual Items or other data will never be lost.

Some jurisdictions do not allow certain warranties to be excluded, so some of the above may not apply to you. Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract.

17. Limitation of liability

To the fullest extent permitted by law, GAMEBORN and its officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, progress or Virtual Items, arising out of or related to the Services or these Terms, even if we were told such damages were possible. Our total liability for all claims related to the Services will not exceed the greater of (a) the amount you paid us through Google Play for the game in the 12 months before the claim arose, or (b) US $50.

These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer in the EEA, the UK or Switzerland, see Section 21.

18. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold GAMEBORN harmless from claims, losses and expenses (including reasonable attorneys' fees) by third parties arising from your breach of these Terms or your misuse of the Services. This section does not apply to consumers in the EEA, the UK or Switzerland.

19. Arbitration and class action waiver

This Section 19 applies if you live in the United States or anywhere other than the EEA, the UK or Switzerland, unless the law where you live does not allow it.

19.1 Try to resolve it informally first

Before starting arbitration or a court case, you and we each agree to send the other a written notice describing the dispute and the relief requested, and to try in good faith to resolve it for at least 60 days. Send your notice to gameborn.owner@gmail.com or by mail to the address in Section 25, with your name, how to contact you, and, if you can, a description of what happened in the game. We will send ours to the contact details you have given us. Time limits for bringing claims are paused during these 60 days.

19.2 Agreement to arbitrate

If the dispute is not resolved informally, you and GAMEBORN agree that any dispute, claim or controversy arising out of or relating to the Services or these Terms (a "Dispute") will be resolved by binding individual arbitration, and not in court, except as described in Section 19.4. The arbitrator, and not a court, decides questions about the scope, validity and enforceability of this Section 19, except that a court decides questions about Section 19.6 (class action waiver) and Section 19.7 (mass filings). The Federal Arbitration Act governs this Section 19.

19.3 How arbitration works

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect when the arbitration is filed, as changed by this Section 19. The AAA's rules and filing forms are available at adr.org. A single arbitrator will decide the Dispute. Unless you and we agree otherwise, the arbitration will take place by video or phone, or on written submissions if the claim is for less than US $10,000, or in the county where you live if an in-person hearing is needed. Payment of filing, administration and arbitrator fees will follow the AAA's Consumer Arbitration Rules. The arbitrator may award the same individual relief a court could, but only to you or to us individually, and only to the extent needed for the individual claim.

19.4 Exceptions: small claims and intellectual property

Either of us may bring an individual claim in small claims court if it qualifies and stays there. Either of us may also go to court to stop infringement or misuse of intellectual property, or to seek urgent injunctive relief, without first using arbitration.

19.5 Time limit

To the extent permitted by law, a Dispute must be started within one year after the claim arose, or it is permanently barred.

19.6 Class action and jury trial waiver

You and GAMEBORN each agree to bring Disputes only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative action, and the arbitrator may not combine more than one person's claims. You and GAMEBORN each give up the right to a jury trial.

If a court decides that this Section 19.6 cannot be enforced for a particular claim or remedy, that claim or remedy (and only that one) will be decided in court under Section 20, after the individual claims in arbitration are finished.

19.7 Mass filings

If 25 or more similar arbitration demands against GAMEBORN are filed by or with the help of the same law firm or organization within 90 days, the AAA's mass arbitration supplementary rules will apply, and the demands will be handled in batches so that they can be resolved in an orderly way. Time limits are paused for demands waiting to be heard.

19.8 Your right to opt out within 30 days

You may opt out of this Section 19 by sending us a notice within 30 days after you first accept these Terms (for example, by first opening the game after they took effect). Send an email to gameborn.owner@gmail.com with the subject "Arbitration Opt-Out", or a letter to the address in Section 25, that includes your name, your contact details, the game you play, and a clear statement that you opt out of arbitration. If you write from the game's "Write to the developer" form, your player identifier is attached automatically. Opting out does not affect any other part of these Terms. If you opt out, Disputes will be decided in court under Section 20.

19.9 Changes and severability

If we change this Section 19 after you accepted it, you may reject the change by writing to us within 30 days after it takes effect, and the previous version will continue to apply to you. If any part of this Section 19 other than Section 19.6 is found unenforceable, the rest stays in effect.

20. Governing law and courts

These Terms and any Dispute are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-laws rules. Any Dispute that is not subject to arbitration will be brought only in the state or federal courts located in Orange County, California, and you and we consent to their jurisdiction. If you are a consumer in the EEA, the UK or Switzerland, see Section 21.

21. Players in the EEA, UK and Switzerland

If you are a consumer living in the European Economic Area, the United Kingdom or Switzerland:

If you believe that content in our Services infringes your copyright, send a notice to gameborn.owner@gmail.com or to the address in Section 25 that identifies the work, the material you believe is infringing and where it appears, your contact details, a statement that you believe in good faith that the use is not authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner, with your physical or electronic signature. We will review notices and remove material where appropriate.

23. Changes to these Terms

We may update these Terms from time to time, for example when we add features or when the law changes. We will post the new version on this page and change the date at the top. If a change is significant, we will also tell you in the game or on this website before it takes effect. Changes apply from the date shown, and not to Disputes that arose before that date. If you keep playing after a change takes effect, you accept the updated Terms; if you do not agree, please stop using the Services.
